Facts

Appellant (Under platform of the Peoples Redemption Party) and the 1st respondent (under the platform Peoples Democratic Party) contested for the chairmanship of Jos North Local Government in the chairmanship elections held on 5th December, 1998.

The 1st respondent was returned as duly elected chairman having scored the majority of lawful votes in the election.

Dissatisfied appellant filed a petition at the Local Government Election tribunal challenging the election of the 1st respondent. The Tribunal at the conclusion of the hearing of the petition dismissed the appellant's petition and confirmed the 1st respondent duly elected Chairman of the Jos North Local Government Council or Plateau State.

Appellant dissatisfied with the decision of the tribunal appealed to the Court of Appeal.
